Things are Cooking

I have not blog the last couple of days. I know that I am suppose to bu the holidays do have a way of changing that. Secondly, I am working on writing a cookbook. I am working on it right now. Writing does take time and taking bit more time with the cookbook. I am scrutinizing it bit more than the book I am ready to publish and put out to the public. Cooking is time consuming and getting the recipes on paper takes a bit more work. I am doing it. I will let everyone know when the cook book is ready. I am going to spend weekends to writing and editing it. I know will lots of re-writes before I consider it perfected. I have been busy writing the last couple days. It is going to be big when I finished. It is practically every recipe that I learned in Australia and some recipes that are not listed anywhere. I am not going publish them on the blog separately. I want it to be surprise. It is a cornucopia of recipes from Texas and Australia. It will be good that I can say.
There will be enough in the cookbook to keep anyone busy. Get out the apron and your chef's hat.

Movies Affect Our Career Decisions
There are certain movies that influence our decision on what wanted to do for a living. There of movies that earn that reputation and influenced my decision to go law school and pursue my dream. The Paper Chase earn that distinction of showing how to deal law professors and their line of questioning. I believe seeing this movie is again and see what goes in law school class.

The one of the movies is where John Houseman tells Timothy Bottoms there is serious doubt about him becoming a lawyer and hands him a dime. He tells Timothy Bottoms. John Houseman as Professor Kingsfield gives a speech about doing brain surgery and having skull full of mush and leaving thinking like a lawyer.
The second film is the Tom Cruise movie the Firm.
I was intrigued by the character was uncovering corruption from the firm he was working for and the firm had threaten to blackmail him. Mitch McDermott, the character Tom Cruise played had graduated from Harvard Law School. The firm was working for the Mafia. The character of Mitch Dermott had uncovered evidence of mob activity and had to prevent himself from being disbarred.
There is Time to Kill where plot takes place in a Mississippi town has to defend a man whose daughter was violently hurt and killed. Samuel Jackson plays the father that sought revenge against the killer of his daughter. Matthew McConaughey plays the lawyer to defend Samuel Jackson. This movie led in the direction I am on now.

My other favorite is A Few Good Men with Tom Cruise as a Navy Lawyer and Jack Nickolson as the Marine Colonel Nathan R. Jessep that gave order that killed a solider on a naval base.

The best scene of the movies was the cross examination that was heated. Movies like this do have a profound impact.
The final nail in the coffin as movies is the classic to To Kill A Mocking Bird
I know from my own experience that these movies did affect my wanting to go law school and want to become a lawyer. Most people have seen these movies at one time or another. It is that reason they have such an emotional impact and it changed they the way I saw things. To this day I still enjoy watching them. If you have not see any of them. It is a good idea to see them a least one time and see how much impact it does leave on your pysche.

Australian Spiced Pumpkin Pie
Sometimes, you can get slight variation on old favorite,pumpkin pie, the American version. The Aussies have their version of the Pumpkin Pie. It is made a bit different. But, it is just as good. I am making this for Thanksgiving. It is sort of after dinner with lattes. The secret is you get to be know what is in it. The Aussies decided to take it to the next level. I learned this recipe about 3 days ago. Bear with me as I try my best to nail it the way I learned it.
Anyhow, this pie says yummy goodness all the way through. It is so Aussie through and through. But, the real secret is seeing the big grins on every ones face while eating. I mean that jello pudding smile like the Cheshire cat that you see people with while eating some. This pie certainly does this treat really well and no one will complain and will ask for second slice to eat.. Let's get cracking the ingredients with the directions. Here they are:
Ingredients
22 oz of pumpkin
1 can evaporated milk
2 eggs, beaten
1 cup dark brown
soft sugar
1/2 teaspoon
ground cinnamon
1/2 teaspoon
ground ginger
1/2 teaspoon
ground nutmeg
1/2 teaspoon salt
For the pastry
3 cups plain flour
1 teaspoon salt
220g butter
1/2 cup cold water
Directions
Preheat oven to
400 degrees Farenheit.
Halve pumpkin if
necessary and scoop out any seeds and stringy portions. Cut pumpkin into
chunks.
In a saucepan over
medium heat, cover the pumpkin with water and bring to the boil. Reduce heat to
low, cover and simmer for 30 minutes or until tender. Drain, cool and cut away
the skin.
Return pumpkin to
the saucepan and mash with a potato masher. Drain well, and measure 18 oz. of
the mashed pumpkin; reserve any excess pumpkin for another use.
Prepare pastry by
mixing together the flour and salt. Rub butter into flour, and add 1 tablespoon
cold water to mixture at a time. Mix and repeat until pastry is moist enough to
hold together.
With lightly
floured hands, shape pastry into a ball. On a lightly floured board, roll
pastry out to about 5mm thickness. Transfer to a 9 inch pie dish, gently
pressing pastry into the base and up sides.
Cut off any excess
pastry hanging over the sides of the dish, and pinch pastry securely around the
inner edge.Refrigerate any remaining pastry for another time.
In a large bowl
with mixer speed on medium, beat pumpkin with evaporated milk, eggs, sugar,
cinnamon, ginger, nutmeg and salt. Mix well.
Pour into a
prepared pie dish. Bake in preheated oven for 40 minutes or until a knife
inserted in the center comes out clean.
This pie is ready to eat and smells great. Your friends and guest will want more at Thanksgiving. They will have the plate in hand and asking for it hand over fist. It tastes wonderful and blissful that this pie will put those bland pumpkins to shame. It is simple to make ,as well as, fun,too.

Proper Attire for presentations and moot court in law school

This a topic that I have not discussed,but it is relevant. Now, I know there are students or law students out there that they because they are not working they think can go in beach shorts or tank tops or wear flip flops or thongs as they are called. If you are going to do a presentation like negotiation or moot court, you need to dress up like you really in court. If you are saying, why are you telling us this? Well, the reason is two fold.
I have seen people show up for a moot court presentation dress wrong and was there a support for my friend in a real court room. There was one guy show up in beach shorts and flip flops. He thought that he didn't need to dress up and thought it was ok. The judge was a REAL federal court of appeals judge that sent him home. It was embarrassing. Guys.. If you have long hair,gentlemen, just tie it back and don't be like the man in the picture above and make sure it is kept neat. Being clean and neat is crucial and determines how you feel about yourself. Gentlemen, you should dress up in suit and tie like this
Ladies, dress like this for court. How you dress determines how you feel and the kind people you will have to deal with the real world. Pretty much like this.
Let clue you in on piece of information about situation where the women were not wearing the right clothing for court. A judge sent a female lawyer home for not wearing the right attire. Here is the link to the article about it.

If you shop at those stores, you can pretty much find the right attire for court. Just treat it like the real deal of representing a client in court.
The other part is attitude. Your attitude pretty much reflect how you treat others and how you feel about your yourself. The best advice is be yourself and don't act cocky,snobbish or arrogant because of going to law school. Try to sympathize with your fellow classmates and dress for success. Just be humble. Also, you need to get automobile insurance just like you did back in the US. Each state in Australia has their own automobile insurance requirement. Also, you need to pay attention the speed limit signs because they are in metric such as km instead of mile per hour. Driving in Oz, the signs are similar in most respects. It is still a good idea to have driver's hand book to know the difference in the streets between what each person has been accustomed to back in the US.

The thing to remember is follow all of the traffic laws. Never argue with a police officer over a ticket. If you do get a ticket, just pay the fine and get it over with.
Also, the other thing is the driving is done on the opposite of the highway than the US. The steering wheel is on the right side of the car and not the left side.
Uluru Dream Trip

It sits around the nature beauty with trees and native brushes. It is sight to be hold that I am told. It is on my top place to go visit and see up close and personal. My plan is to take a tour of Uluru next year between semesters. There is one tour which allows you to get the feel for the real thing by backpacking it. It sounds it right up my alley for adventure.

You can go by camel like in this picture.I wanted to try this for a long time. This kind of trip is adventure.

I want do this trip because it would be a breath of fresh from the mundane and ordinary. This trip would be extraordinary for me.


Just eat by sunset like this and it is life changing in a way. It put me back in touch with G-d and gives me real appreciation for the outdoors. This trip that kind adventure you can take to get away from it. I mean no laptops,no mobile phones, and would be the kind of trip to clear your mind. This is on that going on. It is a part of my adventure as a law student and adventurer that I am going to take. I can't to see the sunset at Uluru and getting the feel for the land there. I will take pictures of it. It will be memories for a lifetime.It is a true blue Aussie adventure. Most of all, this I will remember the experience at Uluru.

Hypothetical regarding Judge Richard G Kopf if it were in Oz

I was reading this article about a judge that turned into his daughter,so he could be appointed to the Federal Bench. The crux of the article was him turning in his daughter to get the appointment. I understand that a father wants to help his daughter was involved in criminal activity. But, I thought what if the matter happen in Oz. Would the feeling be the exact same response. This question is one that came up with.
Let's say that Tony Abbott had a judicial nominee that was going to be appointed the next leg up the judicial hierarchy. What would the reaction be if a judge in the same situation had a son or daughter for that matter that was involved in criminal activity. Now, the crux of the dilemma is if you were same spot like you would turn your son or daughter in to get the appointment. Or would turn your son or daughter in and not take the appointment. I think is interesting question regarding familial relationships and the role of wanting to help but being caught in a spot.
If I had a son or daughter for that matter in the same spot., I would turn them in. But, I would not take the appointment for the simple reason of the way it would look. I don't want to appear selfish. There is a difference in wanting to help a loved one and doing it to get a coveted position. There has to be a clear distinction. I guest to how would Australians act if they had a judge in the same set of circumstances.
This question ask what is the most important thing to do. Is it turning a child in to get a promotion or doing the right thing of turning the child in and not taking the appointment. I would the Australian Legal Community this question how would they react if they were in the same set of circumstances.

Sweet Cajun Potatoes Latkes For Hanukkah and Thanksgiving All Roll into One

Having grown up in Jewish family and know that Hanukkah will happen on Sunset in the US tomorrow. In Oz, It is already the 27th of November. I will be lighting my first candle at sunset tonight. There is a pleasure getting walloped by two holidays in row with Thanksgiving on Thursday and Hanukkah the day before. You know it means double preparation and more fun. I went out this year to make it happen. Already ordered my turkey. I have a bowl sweet potatoes ready to peel. This dish goes back thousand of years and the ordeal of the Maccabbees warting off the Ancient Hellenistic Greek were insisting that their culture should be the rule of law. The Maccabees said "No" and fought off the Greeks and rededicated the temple in Jerusalem long before Christ arrived the on the scene.
I usually like to make my the next day at Thanksgiving especially since I am inviting friends over and my neighbors. The secret to this Cajun spice that savors that Louisiana flavor. When people come over and they always ask for more.. This pretty much a potato pancake. But, it is not. It is a sweet potato masterpiece fried in oil. The oil symbolizes the oil burnt in the temple for 8 days and there was only enough oil for one day.. These taste sweet and they are soooo good to eat. It is even more special that I can serve these puppies and get my friends on their feet. This is where the party really gets hopping.Sure enough, it does the sweetness is one that can't be missed. People will want to know your secret to them.Shhh... Don't say anything. Because I am about to let you on the secret of how to make them. So here we go with the ingredients and direction to makes these prized treasures of sweetness.
Ingredients
2 pounds sweet potatoes (about 3 large), peeled
3 large eggs
2 tablespoons plus 1 teaspoon Cajun Spice Blend
1/3 cup cilantro, chopped
Peanut oil
Sour cream or Guacamole
Directions
Using the coarse grating disc of a food processor, grate the sweet potatoes. Transfer to a large bowl.
In a small bowl, whisk the eggs. Sprinkle the Cajun spice blend into the eggs and whisk. Mix in the cilantro.
Add egg mixture to the grated potatoes.
In a large skillet, heat the peanut oil until very hot but not smoking. If you are using a thermometer, get the oil to 375°F.
Add the sweet potato mixture 1/4 cup at a time. Fry until golden, flip and fry until golden on the other side. Drain on paper towels. Repeat until all the potatoes are used.
Serve with a dollop of sour cream or a dollop of guacamole.
Once, they are ready to come out of the frying on the plate to soak up the grease. They are ready to eat. Don't worry about what your cardiologist or primary care physician says about eating them one time. Eating one time won't kill you.I won't say word. It is our little secret.Now, the fun part is making and giving the away to friend and collegues alike. I like to serve them to my guests at Thanksgiving this year. That is the beauty of these masterpieces of sweetness.
I like put a dollop of guacamole to go with it. Because it tastes so sweet and has all of the Louisiana and Jewish goodness cook right in. In Australia, I make and take them over to my next door neighbors even though are not Jewish. They love them and always ask when I am going to make more. A Sample Case using American Legal Reasoning For Craig Thomson facing Fraud in Oz.

I read the Sydney Morning Herald and discover that a former Labour MP was engaged in fraud and accused of using Health Services Union credit cards to pay for sexual services at brothels and escort agencies, for pornographic movies at hotels, for flights, food and drink, car hire and other expenses while he was the union's national secretary from 2002 to his election to Federal Parliament as a Labor MP in 2007.
I always love for judical news that can fit the blog and this fits this category. Mr. Thomson will face charges. The court rule that the prosecution can go forward with this case. Magistrate Charlie Rozencwajg extended Mr Thomson’s bail. He will face charges with regard to while he was the union's national secretary from 2002 to his election to Federal Parliament as a Labor MP in 2007.
He failed to disclose that he was using credit cards assigned the poltical party that he was a member of. The question he should of though was that every thing is traceable. Whenever you use a credit card and to try to cover up the fact. It just makes the case for fraud even stronger
Let me summarize it in the American legal definition for fraud in this case. Here is how the prosecution is going to prove its case according the legal definition of fraud. The Australia version of this will be different and learning as I go.
Legal Issue
The issue is whether Craig Thomson committed fraud by failing to disclosed his expenses that being used for sex activities and not legitimate activities related to his campaign to the Labour party.
Elements of Fraud
According the legal defintion of fraud, one has to prove fraud the following elements are required : (1) a false statement of a material fact,(2) knowledge on the part of the defendant that the statement is untrue, (3) intent on the part of the defendant to deceive the alleged victim, (4) justifiable reliance by the alleged victim on the statement, and (5) injury to the alleged victim as a result.
The court will have to determine there is a fraud committed by Craig Thomson. Lastly, the fact will show that he did commit fraud based on the elements of fraud and facts fit the legal definition of fraud.
Prosecution Side of the Case
Here on the facts, he knowing made a false statement to the commission of his own party by using the credit card and did not disclose what the expenses were meets the element of false statement of material fact. He had knowledge that of his transactions and did not disclose to Labour Party and let them with falsehood that he knew was untrue and meets the element of knowledge on the part of the defendant that the statement is untrue. The Labour party was the unwilling victim of his false statement by him not disclosing his expenses to them at the time the transactions were made and stated something else other what the expenses were. He had the intent to deceive the Labour Party by lying and covering up his activities and having seem like business expenses related to the campaigning establish the element of intent on the part of the defendant to deceive the alleged victim. The Labour party relied is statements to be true and discovered they were not and had been victimized by his misstatements and relied on those statements to be true establishes the element of justifiable reliance by the alleged victim on the statement. The Labour found out about his misconduct and became a victim of untrue statements of what the credit cards were used on sexual activities that were not authorized by the Labour Party as legitimate expenses and establish the element of injury to the alleged victim as a result.Thus, prosecution has proven its case of fraud.
Defense side of the Case
The defendant will claim the brothels and sexual establishments were not victims and knew that he was engage such activities and did not bother to use his own money. His claim would not be able poke any holes of the elements because the victim was the Labour Party and not the brothels themselves. Thus, he cannot that he did not commit fraud.
Possible Court Conclusion
Craig Thomson did commit fraud because his statements were fraudulent and misled the Labour Party.

Also, I used John Delaney's Legal Reasoning,which American based Legal Reasoning. Now, if this were using legal reasoning in Australia I would have layer each element with case rule and citation and the fact fitting the case rule. The reason is because it suppose to look papers use in court. For our purpose and bar exam purposes, it looks like this in that format. Here is John Delaney Legal Reasoning for Law Exam in American;

No Thanksgiving Turkey is complete Without Dressing in Oz

Well,I have the perfect recipe for it. It goes really well with turkey. My dressing is not the traditional dressing that comes a Thanksgiving dinner. I like to be a different. My dressing has taste that is sweet to eat and to taste as well. The overall secret is ingredients and will put other bland dressings to shame.

Every person will want to know the secret of this dressing. The dressing I make is called Apple Walnut Cornbread Dressing. It will most definitely make everyone want this culinary masterpiece. Because it goes so well with turkey that your friends and family will want more. Let's go with tackle this recipe and here are the ingredients and directions.
Ingredients
1 (9x9 inch) pan cornbread, cooled and crumbled
1 (8 ounce) package herb-seasoned dry bread stuffing mix
2 tablespoons chopped fresh parsley
1/2 teaspoon ground ginger
1/2 teaspoon salt
3/4 cup butter
1 cup chopped celery
1 cup chopped onion
2 cups chopped apples
1/2 cup chopped walnuts
2 cups apple juice
3 eggs, beaten
Directions
Preheat oven to 350 degrees F (175 degrees C). Butter a 3 quart casserole dish.
Melt the butter in a heavy saucepan, and saute the celery and onion for 8 to 10 minutes, or until tender.
In a large bowl, combine the cornbread, stuffing mix, parsley, ginger, and salt. Mix in the celery and onion mixture, chopped apple, chopped walnuts, apple juice, and beaten eggs. Spoon dressing into prepared casserole dish.
Bake for 30 to 35 minutes in the preheated oven, or until heated through, and lightly browned on top.
