Hypothetical regarding Judge Richard G Kopf if it were in Oz

Judge Richard G Kopf

I was reading this article about a judge that turned into his daughter,so he could be appointed to the Federal Bench. The crux of the article was him turning in his daughter to get the appointment. I understand that a father wants to help his daughter was involved in criminal activity. But, I thought what if the matter happen in Oz. Would the feeling be the exact same response. This question is one that came up with.

Let's say that Tony Abbott had a judicial nominee that was going to be appointed the next leg up the judicial hierarchy. What would the reaction be if a judge in the same situation had a son or daughter for that matter that was involved in criminal activity. Now, the crux of the dilemma is if you were same spot like you would turn your son or daughter in to get the appointment.  Or would turn your son or daughter in and not take the appointment. I think is interesting question regarding familial relationships and the role of wanting to help but being caught in a spot.

If I had a son or daughter for that matter in the same spot., I would turn them in. But, I would not take the appointment for the simple reason of the way it would look. I don't want to appear selfish.  There is  a difference in wanting to help a loved one and doing it to get a coveted position. There has to be a clear distinction. I guest to how would Australians act if they had a judge in the same set of circumstances.

This question ask what is the most important thing to do. Is it turning a child in to get a promotion or doing the right thing of turning the child in and not taking the appointment. I would the Australian Legal Community this question how would they react if they were in the same set of circumstances.

Here is the link to the article because it does raise issues in my mind.

Judge Richard Kofp's Daughter and the hard choice

Let me know what you about the issue. I think it is good issue and it is one that concerns about where is the line that should not be crossed. How would handle it in the same circumstances.

http://www.lawschoolcartoons.com/wp-content/uploads/2009/05/Casual-Attire-2.jpg

Well, it time to start to include the most important part of this blog. I will start putting case brief template that can be used for law school. It is one of the ways this blog can put out the help. Because I am going prep for law school and exams. Because a law student not prepared is one that will pay for it later on in one's legal career.

The key to this kind of preparation to keep everyone going law school and get a feel for the law school environment. Also, I want help my fellow law students out there. Especially out in Australia. Because there is very little material to teach out brief a case and to do it well can come in handy at exam time. Also, I am getting in the habit of doing it now,so that I won't forget how to do it. The  good news as  far briefing is concern is that I am using John Delaney's how do legal Analysis. It shows how to brief. With regard to cases in Australia, you can multiple issues  related to a case and to break up the elements with case rules for each element followed by matching set of fact fo the case rule and element that it goes under. Here is the books that I am highly recommending as one law student to another law student.

http://ecx.images-amazon.com/images/I/510N28MR9QL._SY344_BO1,204,203,200_.jpgI know want to think like a lawyer and hit the ground running. This one of the many weapons that I will be using at law school.I am trying to is get a good handle being a good law student. I am hoping to be an even better lawyer when I do graduate.

I am always open to do the Australian version of Planet Law School. I think for the lack material not readily available and that can be free can help many people versus charging people sums of money and never give good information how to do an Australian law school exam and what is the format of it. Because there is very little material on it. It is like a big mystery. I am hoping to get some information out about the Australian law school exam format. Because every law school in every country has their exam answer format that is accepted for that particular country.

I want to get as much input from people who can point me in the right direction. I want help people entering into law school in Australia to prepare and to be able to hit the ground running. this my purpose. My end goal is to be a good lawyer and be able hand really tough cases. This why I am up for the challenge. I am going to use the Dragon Speak Legal Edition to help me brief my cases. I am recommend using it highly.

Dragon Natural Speaking Legal Edition

This is the way to approach to the law school environment. I am treating it as a business. Because working as a lawyer is having to think like a business owner. This mindset is one that I am very familiar with. I am going put somethings together,so that you who are going to be law students or already law students have the information. It is my way getting the information out for free. It will be free.Because who is better at understanding other law student than a person who is a law student. Paying it forward is one of the things that I can offer to other law students. I will try to get more info on the exam format so that you will know how to prepare for it and how to create and outline that is usable for the law school environment.Don't be afraid to contact me if you have information that I do not have. After all, I want this blog to be resource of information for law students. Just hit the contact button if you have any comments or questions because they are always welcomed. I will try to get to as many as I can.
